Darfur: do we say goodbye to the humanitarian international law and international organizations?

The Sudanese Armed Forces supported the military militia, Al Janjaweed, through the Sudanese air force, by launching an air strike on the region of "Sarba", west of Darfur; which was earlier occupied by the Movement of Justice and Equality.  The strikes did not distinguish between the fighters of the movement and the civilians, inhabitants of the region, who have earlier sought refuge in it.  This attack led to the death of 100 civilians and the fleeing of nearly (12000) civilians to Chad.  It is worth mentioning that this area has around (130000) internal refugees who have not received any food supplies since last December until today.  "UNIMED", the joint delegation between the United Nations and the African Union moved to the West to investigate cases of killing and forced immigration.  The leader of the Movement of Justice and Equality proclaimed that "UNIMED" can enter the area but cannot stay for long.  He also warned that his movement might attack the International Forces.

The Arab Program for Human Rights Activists expresses its shock at the severity of the numbers that indicate the sufferings of the civilian population in Darfur due to the armed struggle between the different parties fighting in the area.  The program hopes that these horrific numbers will move the international community through its organizations and bodies to fulfill their roles to protect and to defend the civilians of Darfur and to send to them food and medical supplies to enable them to exercise their lives in a normal and safe manner as was stipulated by international conventions, especially the Geneva Convention concerning the protection of civilians during armed struggles;  in addition to all United Nations agreements related to human rights and fundamental liberties.  The Program also holds responsible all parties operating in Darfur, the Sudanese Government, various armed movements, and the silent international community concerning these crimes as well as Arab and non-Arab Regimes that are supporting the Sudanese Government for the deteriorating and worsening humane conditions  in Darfur.

The Arab Program reaffirms that if the organizations and bodies of the international community fail to safe the civilians of Darfur from what they are subjected to; or if they fail in delivering food supplies to them, it is considered a signal of encouragement to commit more crimes in different parts of the world; as well as deep rooting a new tradition which encourages non respect of the principles and the rulings of the International Humane Law and the International Law of Human Rights.  It will also encourage taking lightly the decisions of the United Nations and ignoring their execution by depending upon relationships and political interests with the poles of the International Movement.  We reaffirm that the New World Order does not mean giving up all what has been produced by the human races through their long struggle and history to affect agreements, conventions and pacts to protect human beings and to organize international relations.  Instead, the rule of the jungle will prevail and survival will be for the fittest; in addition to promoting political, economic and strategic interests at the expense of human values and man at large.

The Arab Program calls upon organizations and bodies of the international and Arab communities to seriously work to safe human and legal heritages through working to respect and to implement them in the struggle that is raging in the Region of Darfur; to safe civilians from atrocities they are suffering from, and to work on delivering food supplies needed by them; in addition to expediting the activation of the file in the International Criminal Tribune concerning this tragedy.

بيان عاجل

دارفور:هل نقول وداعا للقانون الدولي الانساني

وللهيئات الدولية

          قامت القوات المسلحة السودانية بدعم ميليشيات الجنجويد عبر سلاح الطيران السوداني بمهاجمة منطقة"صربا"في غرب دارفور،والتي كانت تحتلها في وقت سابق حركة العدالة والمساواة،ولم تفرق تلك الهجمات-والتي حدثت يوم الجمعة 8 فبراير الجاري- بين مسلحي الحركة وبين المدنيين من سكان المنطقة أو الذين نزحوا إليها في وقت سابق،مما أدي إلي مصرع (100)مدني ونزوح ما يقرب من (12000)مدني إلي تشاد،وجدير بالذكر أن تلك المنطقة بها (130000)نازح داخلي لم تصل إليهم أية مساعدات غذائية من ديسمبر الماضي حتي اليوم،وقامت "اليوناميد""البعثة المشتركة بين الأمم المتحدة والإتحاد الإفريقي بالانتقال إلي غرب للتحقيق في عمليات القتل والتهجير القسري،كما اعلن زعيم حركة العدل والمساواة أن اليوناميد  تستطيع دخول المنطقة بيد انها لا تستطيع البقاء فيها وحذر من مهاجمة الحركة للقوات الدولية.

إن البرنامج العربي لنشطاء حقوق الإنسان إذ يفزع من هول تلك الأرقام التي تشي بما يعاني منه السكان المدنيين في دارفور من جراء الصراع المسلح بين مختلف الفرقاء المتصارعين في دارفور فإنه يأمل ان تحرك هذه الأرقام المخيفة المجتمع الدولي بمؤسساته وهيئاته للقيام بأدوارهم في حماية مدنيي دارفور والدفاع عنهم وإيصال المواد الغذائية والأدوية لهم وتمكينهم من ممارسة حياتهم بشكل طبيعي آمن كما قررت الاتفاقيات الدولية ذلك وخاصة اتفاقية جنيف بشأن حماية المدنيين في زمن النزاعات المسلح وكافة اتفاقيات الأمم المتحدة المتعلقة بحقوق الإنسان وحرياته الأساسية.

 ويحمل البرنامج العربي كافة الأطراف العاملة علي أرض دارفور"الحكومة السودانية والحركات المسلحة المتعددة هناك والمجتمع الدولي الصامت علي هذه الجرائم والأنظمة الحاكمة العربية وغير العربية التي تدعم الحكومة السودانية "مسئولية ما وصلت إليه الأوضاع الإنسانية من سوء وتردي في إقليم دارفور.

كما يؤكد البرنامج العربي أنه وإن فشل المجتمع الدولي بهيئاته ومؤسساته في العمل علي انقاذ مدنيي دارفور مما يتعرضون له أو فشل في توصيل مواد الإغاثة إليهم فإن ذلك يعد إيذانا بالمزيد من الجرائم في مناطق العالم المختلفة وترسيخ عرف جديد مفاده عدم احترام مبادئ وأحكام القانون الدولي الإنساني والقانون الدولي لحقوق الإنسان والاستهانة بقرارات الأمم المتحدة وعدم تنفيذها ركونا إلي العلاقات والمصالح السياسية مع أقطاب الحركة الدولية،ونؤكد أن النظام العالمي الجديد لا يعني أن نتخلي عن كل ما أنتجته البشرية عبر نضالها وتاريخها الطويل من اتفاقيات وعهود ومواثيق لحماية الإنسان ولتنظيم العلاقات الدولية وتبني نظام الغابة والبقاء للأقوي،والاعلاء من قيم المصالح السياسية والإقتصادية والاستراتيجيه علي حساب القيم الإنسانية والانسان ذاته.

ان البرنامج العربي يدعو مؤسسات وهيئات المجتمع الدولي والعربي العمل بجدية لانقاذ تراث البشرية القانوني والانساني من خلال العمل علي احترامه وتنفيذه في الصراع الدائر في إقليم دارفور وانقاذ المدنيين فيه من الويلات التي يعانون منها،والعمل علي ايصال المساعدات الغذائية إلي من يحتاجونها فيه،وكذلك سرعة تفعيل الملف الموجود في المحكمة الجنائية الدولية بهذا الخصوص.
